By accessing our website or engaging the services of Mel Colvin Photography, you agree to be bound by these Terms and Conditions. Please read them carefully before booking.

1. Services

Mel Colvin Photography offers branding, headshot, wedding, senior, maternity, newborn, family, and portrait photography services in Rhode Island, Massachusetts, and surrounding New England areas.

2. Booking and Payment

A signed contract and non-refundable retainer are required to secure your date. Your date is not held until both are received. Retainers are non-refundable under any circumstances. Final payment is due prior to or on the date of your session or wedding, as specified in your individual contract. Failed or returned payments may incur additional processing fees.

3. Cancellations and Rescheduling

All cancellations must be submitted in writing to hello@melcolvinphotography.com. Cancellations made with less than 30 days notice of a portrait or branding session, or less than 90 days notice of a wedding, will forfeit the full retainer. Rescheduling is subject to availability and may incur a fee.

4. Copyright and Image Ownership

All photographs created by Mel Colvin Photography are protected by United States copyright law. Mel Colvin Photography retains full copyright ownership of all images. Clients receive a limited personal use license to print and share images for non-commercial purposes. Sale or commercial use of images, editing or altering delivered images, removing watermarks, and submitting images to publications or third parties all require prior written permission.

5. Portfolio and Marketing Use

Mel Colvin Photography reserves the right to use images from any session for portfolio, website, blog, social media, contests, and other marketing purposes. Clients who wish to keep their session private must sign a written privacy agreement prior to their session, which may incur an additional fee.

6. Image Delivery

Images are delivered via an online gallery within the timeframe specified in your individual contract. Delivery times vary by session type. Rush delivery may be available for an additional fee. Digital files are provided unless print products are separately purchased.

7. Image Storage

Client images are stored for a limited period following gallery delivery. We strongly recommend downloading and backing up all images immediately upon receipt. Mel Colvin Photography is not responsible for image loss after the storage period has expired.

8. Weather and Outdoor Sessions

Outdoor sessions are subject to weather conditions. In the event of inclement weather, sessions may be rescheduled at no additional charge. Final weather decisions are made by Mel Colvin Photography in consultation with the client.

9. Conduct and Safety

Mel Colvin Photography reserves the right to terminate a session if a client or their guests engage in behavior that is threatening, abusive, or endangers the safety of the photographer. In such cases, no refund will be issued.

10. Limitation of Liability

In the event of equipment failure, illness, accident, or circumstances beyond our control, Mel Colvin Photography's liability shall be limited to a refund of monies paid. We are not liable for failure to deliver images due to causes outside our reasonable control.

11. Governing Law

These Terms and Conditions shall be governed by the laws of the State of Rhode Island. Any disputes arising from these terms shall be resolved in the courts of Rhode Island.
